Streszczenie
Kwestia praw zwierząt wymaga określenia ich natury formalnej oraz uzasadnienia w sferze fi lozofi i i etyki. Należy dokładnie określić jakie istoty i na jakiej podstawie mogą posiadać prawa oraz kto powinien je respektować. Prawa ludzkie traktują o przywilejach, ale również o obowiązkach wynikających z ich przestrzegania. U ich podstaw leży ochrona jednego człowieka przed drugim, czyli praktyczna realizacja idei bezpieczeństwa. W odniesieniu do zwierząt, prawa mogą określać tylko to, co zwierzętom przysługuje z ich natury, bez możliwości oczekiwania spełniania jakiegokolwiek obowiązku z ich strony.

The att empt of the theological justifi cation of animal right based on „The Theology of Animals” by Andrew Linzey
Abstract
The issue of animal rights requires the defi nition concerning its formal nature as well as substantiation in the fi elds of philosophy and ethics. It is necessary to determine what kind of creatures should have rights, on what basis and by whom those rights should be respected. Human rights refer to the privileges and the duties arising from the abiding of those. They are based on the protection of one human being against another, which is the practical implementation of the safety. When we talk about animals we can only determine what animals are entitled to by the rights of nature, without expecting that animals will fulfill any duties that we may require them to fulfill.
